Terms of service

These terms govern your use of the Mightlings app and the mightlings.app website. By downloading, opening or using the app, you confirm that you have read and accepted these terms and the privacy policy, which forms part of them. If you do not accept them, do not use the app.

The current version of Mightlings is free and has no accounts, data collection, advertising or purchases.

The app is made for children roughly two to five years old and should be used with a parent or caregiver. The app has no accounts. You must be at least 18 and legally able to enter into a binding agreement to accept these terms. You also accept them on behalf of any child who uses the app on your device.

You are responsible for deciding whether a given story suits your child, and for supervising their use of the device.

3. What Mightlings is, and what it is not

Mightlings plays one short narrated bedtime story at a time with an animated character, then goes quiet. This is the app's main function.

It is not a medical device, a therapy, a diagnostic tool, or a treatment for any sleep problem. Our design notes describe the sleep and lullaby research considered during development, but we do not promise a particular outcome for your child. If you are concerned about your child's sleep, consult a healthcare professional.

4. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Mightlings on devices you control, for private and non-commercial use.

You may not: sell, rent, sublicense or redistribute the app; extract, re-upload or republish its stories, narration audio, music, artwork or 3D characters; reverse-engineer or decompile it except to the extent applicable law expressly allows; or use it to build a competing product.

5. Who owns what

The app, its stories, narration, music, artwork, characters and code belong to Supastack Teknoloji Limited Şirketi or to the people we licensed them from. Nothing in these terms transfers any of that to you. "Mightlings", "Lumi" and "Otto" are our marks.

The app does not accept user-generated content or uploads, so you do not grant us a licence to any user content.

6. Price, purchases and advertising

Mightlings is free at version 1.0. There are no in-app purchases, no subscription, and no advertising of any kind.

If a future version adds an optional paid subscription for additional stories, it will be sold through the Apple App Store or Google Play under their billing terms, it will sit behind a parental gate, and everything free today will stay free. We will say so in the app before any such version ships.

7. Availability and changes to the app

We take reasonable steps to keep the app working, but we do not guarantee uninterrupted or error-free operation, a particular service level or any minimum uptime. The app runs offline once installed, so an outage on our side does not stop a story already on your device.

We may add, change or remove stories, friends and features in later versions. Your store's own update settings decide when a new version reaches you.

8. Acceptable use

Use the app lawfully. Do not attempt to gain unauthorised access to it or to our systems, interfere with it, or use it in a way that breaks the law where you are.

9. Disclaimers and liability

The app is provided "as is" and "as available", without warranties of any kind beyond those applicable law requires and does not permit us to exclude.

To the fullest extent the law allows, Supastack is not liable for indirect, incidental, special or consequential loss, or for loss of data or profit, arising out of the app. Our total liability in any twelve-month period will not exceed the greater of what you paid us for the app in that period and 1,000 Turkish lira. At version 1.0, the amount paid to us for the app is zero.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded, including under mandatory Turkish consumer protection or data protection law.

10. App store terms

You get Mightlings through the Apple App Store or Google Play, and your use is also subject to that store's own terms. Apple and Google are not parties to this agreement, are not responsible for the app, and have no obligation to provide support for it. For iOS: Apple is a third-party beneficiary of these terms and may enforce them against you.

11. Ending this agreement

You may end it at any time by deleting the app. We may suspend or withdraw the app, or a version of it, from distribution; if we do, stories already installed on your device keep working until you remove them.

12. Governing law and disputes

These terms are governed by the law of the Republic of Türkiye, without regard to conflict of law rules.

Before going to court, please write to support@mightlings.app. We normally respond within 10 business days. However, you do not have to contact us before using the remedies below.

If you are a consumer within the meaning of Turkish Consumer Protection Law No. 6502, you keep the right to bring a dispute before the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or the Consumer Court where you live or where the transaction took place, within the statutory monetary limits. These terms do not and cannot restrict that right. Consumers resident in the EU/EEA likewise keep the protection of the mandatory law of their own country.

For all other users, the Istanbul (Çağlayan) Courts and Execution Offices have exclusive jurisdiction.

13. General

If a provision is found invalid or unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or sale of assets.

These terms are published in English and Turkish. Where the two differ, the Turkish version prevails.

14. Changes to these terms

We may update these terms. When we make a material change we update the version number and the effective date above. Continuing to use the app after an update takes effect means you accept it.
